Mr. Kagen is a partner based in the Firm's New York office and focuses his practice on litigation, primarily in the areas of business and securities law. He has represented a broad range of clients, including both public and private companies and individuals, in a wide variety of disputes.
Recent engagements include:
- Representing a $75 million hedge fund against a large commercial insurance entity to recoup $3.5 million owed due to subparticipation rights under a total return swap agreement;
- Representing a seller of a corporate entity in an interpleader action involving several million dollars of money from the sale in a "holdback" dispute with the purchaser and the escrow agent;
- Representing a construction company against a developer for unpaid fees, including with regard to mechanics lien issued in connection therewith;
- Advising a billion dollar pharmaceutical manufacturer in connection with joint ventures and other contractual agreements;
- Representing an individual in connection with a securities litigation filed in federal court, involving issues of federal and foreign law, due to an investment relating to Bernard Madoff;
Previously, Mr. Kagen was associated with Paul, Weiss, Rifkind, Wharton & Garrison, LLP in New York, and Wilson, Sonsini, Goodrich & Rosati in Palo Alto, California. Mr. Kagen's trial experience, on behalf of plaintiffs and defendants, includes breach of contract disputes; real estate disputes; employment disputes; unfair competition, non-compete and restrictive covenant cases; securities litigation and arbitration matters, partnership disputes, and intellectual property disputes including copyright and patent infringement.
